Terms and Conditions of Sale

1. SELLER

These Terms of Sale apply to sales made on ilmcollections.com by Ilm Collections, operated by Cornelus Nassima, a sole trader registered under SIRET 929 908 770 00019, 17B Avenue Franklin Roosevelt, 69150 Décines-Charpieu, France. Contact: info@ilmcollections.com.

2. SCOPE

By placing an order, the consumer accepts these terms. Each product page describes the essential characteristics, price and availability at the time of purchase.

3. PRODUCTS

Photographs and illustrations aim to show products accurately but do not replace the product description. Minor colour differences caused by screens or manufacturing do not necessarily constitute a defect.

4. PRICES

Prices are displayed in the currency of the selected market and include taxes where required by law. Delivery charges and any known customs duties or import fees are shown or calculated before the order is confirmed. Ilm Collections may change future prices; the price confirmed at checkout remains the applicable price.

5. ORDERS

Before payment, the customer must check the basket, delivery address, delivery method and total amount. The order becomes binding once payment is accepted and the confirmation email is sent, subject to an obvious error, suspected fraud or exceptional unavailability. In the latter case, the customer will be informed and refunded without undue delay.

6. PAYMENT

Payment is made using the options offered at checkout. Payments are securely processed by the displayed providers. Ilm Collections does not retain complete bank-card details.

7. PRE-ORDERS

A product marked as a pre-order is not immediately available. The estimated dispatch period appears on its product page. Payment reserves the item. If the estimated date changes materially, the customer will be informed and may request cancellation and a refund for the item not yet dispatched.

8. DELIVERY

Delivery areas, prices, estimated timeframes, carriers and tracking arrangements are described in the Shipping Policy and displayed before payment. The risk of loss or damage transfers to the consumer when they physically receive the goods, except where the consumer independently chooses a carrier not offered by Ilm Collections.

9. RIGHT OF WITHDRAWAL

For distance sales governed by European Union law, consumers have 14 days from receipt of the goods to notify their decision to withdraw without giving a reason. When an order is delivered in several parcels, the period begins upon receipt of the last relevant item.

The request must be sent to info@ilmcollections.com and clearly state the order number and the decision to withdraw. The product must then be returned within 14 days of that notification to the logistics address provided by our customer service. Unless the product is defective or we made an error, the direct return costs are borne by the customer.

Any sums due, including the initial standard delivery charge where required by law, will be refunded to the original payment method within 14 days of the withdrawal notice. The refund may be withheld until the goods are recovered or evidence of dispatch is supplied, whichever occurs first. A deduction may be made for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and proper functioning of the goods.

Statutory exceptions to the right of withdrawal apply in particular to personalised products, digital content fully supplied after prior agreement and express waiver where the legal conditions are met, and unsealed goods that cannot be returned for hygiene reasons where provided by law.

10. RETURNS, EXCHANGES AND REFUNDS

Practical arrangements are set out in the Refund Policy. Contact us to obtain the correct logistics address and instructions. This practical step does not restrict your statutory cancellation right. A model cancellation form is available in our return policy.

11. STATUTORY GUARANTEES

Consumers benefit from the statutory guarantee of conformity and the guarantee against hidden defects under the conditions and time limits provided by law. For a defective or non-conforming product, contact info@ilmcollections.com with the order number, a description of the issue and, where possible, photographs. These rights apply independently of any commercial warranty.

12. LIABILITY AND FORCE MAJEURE

Ilm Collections is responsible for performing its obligations within the limits provided by law. Nothing in these terms restricts mandatory consumer rights. Neither party is liable for a failure caused by an event recognised as force majeure under applicable law.

13. INTELLECTUAL PROPERTY

Purchasing a product does not transfer any intellectual-property right in Ilm Collections games, cards, text, illustrations, audio, photographs, logos or creations. Any unauthorised reproduction or use is prohibited.

14. PERSONAL DATA

Personal-data processing connected with orders and customer service is described in the Privacy Policy.

15. COMPLAINTS AND MEDIATION

Any complaint must first be sent to info@ilmcollections.com so that an amicable solution can be sought. The consumer may then use the competent consumer mediator free of charge under the conditions provided by law, or use any other available form of amicable dispute resolution.

16. GOVERNING LAW AND DISPUTES

These terms are governed by French law. Consumers retain the benefit of mandatory provisions of the country in which they live. If no amicable agreement is reached, the competent courts are determined under the applicable legal rules.
